Bertrand Lionel-Marie advises employers, contractors and designers on all contractual and regulatory matters of construction operations: drafting, auditing and negotiation all contracts (works contracts, property development contracts, architect agreements, project management agreements, construction management agreements, etc.), bank bonds, subcontracts, contract management and pre-contentious (change orders, amendments, claims, final accounts, etc.).
Bertrand Lionel-Marie assists his clients in legal survey (pre-construction survey, financial claims and accounts between the parties, construction defects, abnormal neighborhood disturbances, etc.). He represents them before civil, commercial and administrative courts, and alternative dispute resolution bodies (conciliation, mediation, arbitration), in all disputes related to construction contracts (defaults of payment, recovery, delays, subcontracting, consortium, pro rata account, fire safety, abandonment of building site, suspension, termination etc.), to the liabilities and warranties of the constructors.
Bertrand Lionel-Marie also provides advice in the field of real estate law, and in particular in co-ownership law, litigation relating to the sale of real estate, commercial leases, etc.
Bertrand Lionel-Marie practices in public business law with a dominant activity in public contract law, public works and town planning. He advises his clients on procurement procedures and assists them in responding to calls for tenders, attending hearings, participating in negotiations ... He defends and represents his clients in all disputes related to the procurement and awarding of public contracts (in pre-contractual or contractual summary proceedings and/or substantive proceedings, prefectural referral (‘déféré préfectoral’) etc. He intervenes in all disputes related to the financial and technical performance of public contracts and the termination of said contracts.
A graduate of the University of King’s College (MSc in Construction Law and Arbitration), Bertrand Lionel-Marie has fluent languages skills in English.
He has regularly contributed to the drafting of articles for the construction section of the RTDI (Quarterly Real Estate Law Review).
He provides advice to companies operating in various industries: buildings and civil engineering works, transport infrastructures, renewable energies, real estate development, telecommunications, hotels, schools, cultural and sport facilities, pharmaceutical industry, etc.
Education and experience
Bertrand Lionel-Marie is a member of the Paris Bar and holds a DEA (Master) in Public Law and a DEA (Master) in International Law from the University of Paris II Panthéon-Assas, a Master in Business Administration from IAE-Paris (University of Paris I Panthéon, Sorbonne Business School) and a MSc. in Construction Law and Arbitration of King’s College London (University of London). He is a graduate of Langues’O (National Institute of Oriental Languages and Civilizations).
He started his career with a construction major as an in house lawyer in a subsidiary specializing in networks, then as the contract manager of a telecommunications infrastructure project.
After having practiced, between 2002 and 2007, in English (Clifford Chance) and French (Lefèvre Pelletier & Associés) law firms, in charge of construction files mainly for employers, he set up his own niche practice in construction and public contracts in 2007.
In 2020, he joined LA BRUYERE to provide his clients with complementary skills.
