Litigation

LA BRUYERE assists clients in judicial surveys (expertises judiciaires) (so-called preconstruction surveys, contractors’ claims and accounts between the parties, delays, extensions of time and liquidated damages, latent defects, abnormal neighborhood disturbances, etc.).

We analyze the chances of success of a case, assist our clients in finding out of court amicable settlements and defend their interests before civil, commercial and administrative courts (both in summary proceedings and on the merits) as well as in alternative dispute resolution (conciliation, mediation, arbitration).

We act in all litigation related to construction contracts: abusive breaches of negotiations, payment defaults, recovery (conservatory seizures, temporary mortgages, etc.), supplementary works, disruption, unforeseen events, delays (liquidated damages for late delivery, extensions of time...), subcontracting (direct action, irregular subcontracting), consortium agreements, pro rata account, inter-companies account, fire safety, abandonment of works site, suspension, termination and all litigation related to constructors’ liabilities.
